What is the family petition?

The family petition is a process by which a U.S. citizen or permanent resident applies to allow a member of his or her foreign family to obtain an immigrant visa to enter and live in the United States on a permanent basis. Requirements

Sponsor requirements:

  • You must demonstrate that you have sufficient income to support the beneficiary and that you will meet the income requirements established by USCIS.

Tax compliance:

  • You must be current with your federal taxes and provide proof of such.

  • You must provide solid proof of your U.S. citizenship or permanent resident status.

  • Submit accurate forms and appropriate documents to support your application.

Here are some common categories and their general requirements:

Spouse of a U.S. citizen (Ir-1, Cr-1):

  • You must be legally married to a U.S. citizen. The relationship must be genuine and not for convenience. If you file the petition while outside the U.S., you must wait for approval before entering as a permanent resident.

2. Minor children of U.S. citizens (IR-2):

  • You must be an unmarried child under 21 years of age of a U.S. citizen.

3. Adult children of U.S. citizens (F1, F3):

  • You must be an unmarried child and 21 years of age or older. Waiting times may vary and depend on the category and nationality of the applicant.

4. Married children of U.S. citizens (F3):

  • You must be the married child of a U.S. citizen.

5. Children of permanent resident (F2A, F2B):

  • You must be an unmarried or married child of a permanent resident. The F2A and F2B categories have different requirements and waiting times..

6. Parents of U.S. citizen (IR-5):

  • You must be the parent of a U.S. citizen and be at least 21 years old.
