What is Temporary Protected Status (TPS)?

Temporary Protected Status (TPS) is a temporary immigration status for eligible aliens from designated countries. TPS is granted to aliens in the United States who are temporarily unable to return to their countries because of environmental disasters, continuing armed conflict, or other extraordinary conditions.

Requirements that must be met by TPS applicants:

Proof of nationality

Passport, birth certificate with photo ID, OR national ID from an approved country with your photo and/or fingerprint.

2. Proof of date of entry (before the date specified for your country)

Entry stamp in passport, I-94 Arrival/Departure Record or other documents proving your entry into the U.S.

3. Proof of residence in the U.S. from the date specified for your country or before the time of your prior to the time of your application. Proof may include such things as:

  • Employment records (pay stubs, W-2 forms, IRS tax transcripts, state verification of state tax returns, letters from your employer, statements from banks you have done business with).
  • Rent receipts, utility bills (gas, electricity, telephone, etc.), receipts or letters from companies showing the dates you received service.
  • School records (report cards, letters, etc.) from schools you or your children attended in the U.S., showing the names of the schools and dates of attendance.
  • Medical or hospital records for treatment you or your children received, showing the name of the medical facility or physician and the dates of treatment or hospitalization.
  • Certificates from churches, unions or other organizations, regarding your residence and identifying you by name.
  • Other miscellaneous documents, such as birth certificates of your children born here, dated bank transactions and wire transfers, letters, U.S. Social Security card, driver's license, Selective Service card, contracts, mortgages, insurance policies, etc.

What forms do I need to apply?

To apply for TPS, you must file at least Form I-821. If you want an employment authorization document (work permit), you must also file Form I-765. If you want to apply for a fee waiver, you must file Form I-912 (or request a fee waiver in writing). You may be required to file Form I-601 if certain "inadmissibility grounds" apply to you.
